PLEA AGREEMENT
The State of Florida, by and through the undersigned Assistant State Attorney, and the defendant, Jeffrey Edward Epstein, by and through his attorneys, hereby enter into the following plea agreement:
CHARGES AND PLEAS
1. The defendant agrees to plead guilty to one count of Felony Solicitation of Prostitution in violation of Florida Statutes § 796.07(2)(f), a third-degree felony, and one count of Felony Procurement of Minors for Prostitution in violation of Florida Statutes § 796.03, a second-degree felony.
TERMS OF SENTENCE
2. The defendant shall be sentenced to eighteen (18) months incarceration in the Palm Beach County Jail, followed by twelve (12) months of community control (house arrest) and twelve (12) months of sex offender probation.
3. The defendant shall register as a sex offender pursuant to Florida Statutes § 943.0435.
4. The defendant shall pay restitution to identified victims as determined by the Court.
WORK RELEASE
5. The defendant shall be permitted to participate in the Sheriff's work release program during his period of incarceration, subject to the approval of the Palm Beach County Sheriff's Office. Under the work release program, the defendant shall be permitted to leave the facility for up to 12 hours per day, six days per week, to report to his office in West Palm Beach.
COOPERATION
6. The defendant agrees to fully cooperate with any investigation or prosecution arising from the conduct described in this agreement.
NON-PROSECUTION AGREEMENT
7. This plea agreement was entered contemporaneously with a federal Non-Prosecution Agreement (NPA) executed between the defendant and the United States Attorney's Office for the Southern District of Florida, which provides that the United States will defer federal prosecution of the defendant and any potential co-conspirators in exchange for the defendant's guilty plea in this state proceeding.
ACKNOWLEDGMENTS
8. The defendant acknowledges that he has been fully advised of his rights by counsel, that he understands the charges and potential penalties, and that he enters this plea voluntarily and of his own free will.
