MEMORANDUM OPINION AFFIRMING PROBATE ORDERS
Matter of the Estate of Jeffrey E. Epstein, Deceased
Case No. ST-2021-RV-00005
Filed: February 4, 2022
This memorandum opinion by the Superior Court of the Virgin Islands resolved the government's probate appeal. The court affirmed two magistrate orders: one denying the Virgin Islands government's motion to intervene in the probate action as a claimant against the estate, and another striking the government's emergency motion to freeze all estate assets and cash on hand.
The opinion recites the relevant chronology. Epstein died in custody on August 10, 2019, and the probate estate was opened on August 15, 2019. The estate later sought court authorization for an independent voluntary claims program for sexual abuse claims. In January 2020, the Virgin Islands government filed a separate civil lawsuit against the estate, the 1953 Trust, business affiliates, and associates seeking forfeiture, divestment, civil penalties, damages, and related remedies.
For archive users, the opinion is important because it separates probate administration from the government's civil enforcement case. The government sought to use probate intervention and an emergency freeze to influence estate-asset control. The court concluded that the challenged magistrate rulings should stand, leaving the government to pursue remedies through other procedural routes rather than as an intervenor in the probate matter.
The decision is not a merits ruling on trafficking allegations or on the government's separate civil claims. Its value is procedural: it defines the court's treatment of asset-control efforts inside the estate case and explains why the probate court did not become the main vehicle for the Virgin Islands government's forfeiture and divestment theories.
