SECOND CIRCUIT OPINION — MAXWELL v. UNITED STATES Case No. 22-2366 U.S. Court of Appeals for the Second Circuit Decision Date: September 17, 2024 HOLDING: Conviction AFFIRMED on all counts. Maxwell appealed her December 2021 conviction on five federal counts related to sex trafficking and conspiracy. Her appeal raised multiple grounds: ISSUES ON APPEAL: 1. Juror Misconduct — Maxwell argued that Juror No. 50's failure to disclose personal history of sexual abuse during voir dire warranted a new trial 2. Evidentiary Errors — Challenges to the admission of certain testimony and exhibits 3. Sufficiency of Evidence — Argument that evidence was insufficient on certain counts 4. Sentencing — Challenge to the 20-year sentence as substantively unreasonable COURT'S ANALYSIS: The Second Circuit rejected all arguments. On the juror misconduct issue, the court found that the district court did not abuse its discretion in denying the motion for a new trial, concluding that the juror's nondisclosure was not deliberate and that Maxwell had not demonstrated actual prejudice.
